Article R613-27 of the French Intellectual Property Code

The one-year period provided for in paragraph 2 of Article L. 613-18 runs from the day of receipt of the notification provided for in Article R. 613-26. The legitimate excuses provided for in paragraph 3 of article L. 613-18 must be presented within this time limit.

The additional period that the Minister responsible for industrial property may grant to the interested party by virtue of the same paragraph 3 shall run from the date of expiry of the said one-year period.

The decision granting this additional period is taken and notified in accordance with the procedure and in the forms laid down for the formal notice decision in Article R. 613-26.

Le délai d’un an prévu à l’alinéa 2 de l’article L. 613-18 court du jour de la réception de la notification prévue à l’article R. 613-26. Les excuses légitimes prévues à l’alinéa 3 de l’article L. 613-18 doivent être présentées dans ce délai.

Le délai supplémentaire que le ministre chargé de la propriété industrielle peut accorder à l’intéressé en vertu du même alinéa 3 court à compter de la date d’expiration dudit délai d’un an.

La décision accordant ce délai supplémentaire est prise et notifiée selon la procédure et dans les formes prévues pour la décision de mise en demeure à l’article R. 613-26.
