Where opposition proceedings are suspended pursuant to the provisions of 1° of Article R. 613-44-10, they shall be resumed at the request of one of the parties forwarding to the National Institute of Industrial Property the decision ruling on the ownership claim or invalidity that has become res judicata.
Where opposition proceedings are suspended pursuant to the provisions of the fourth paragraph of Article R. 613-44-10, they shall be resumed at the request of one of the parties or, where applicable, upon expiry of the period provided for in Article R. 613-44-10.
Where opposition proceedings are suspended pursuant to the provisions of the fourth paragraph of Article R. 613-44-10, they shall be resumed at the request of one of the parties or, where applicable, on expiry of the time limit provided for in that same paragraph.
When opposition proceedings are resumed, the National Institute of Industrial Property shall inform the parties of the date of resumption.
When the opposition procedure is resumed, if the scope of the patent has been modified, the opponent is invited to submit a new declaration pursuant to Article R. 613-44-1, 3°, within a time limit set by the Institute.
The resumption of the opposition procedure is notified to the opposing party.
The parties will be notified of the resumption of proceedings by the Institute without delay, with an indication of the resumption date.
