Article R6132-21-1 of the French Public Health Code

I. – The staff members who carry out the activities, functions and missions mentioned in article L. 6132-3 are appointed to their duties, on behalf of the participating establishments, by the director of the support establishment in accordance with the organisation and operation of the grouping as set out in the grouping’s constituent agreement.

II. – The director of the support institution may delegate his signature to staff recruited by this institution or made available to it to carry out the activities, functions and tasks mentioned in article L. 6132-3.

III. – Staff from the army hospitals associated with the regional hospital grouping may not be appointed by the grouping’s support establishment to carry out the activities, functions and tasks mentioned in I on behalf of the establishments that are party to the grouping. They may contribute to the performance of these activities or tasks under the conditions laid down in the constituent agreement.

Article R6132-21-1

I. – Les agents qui assurent les activités, fonctions et missions mentionnées à l’article L. 6132-3 sont nommés dans leurs fonctions, pour le compte des établissements parties, par le directeur de l’établissement support selon l’organisation et le fonctionnement du groupement prévus par la convention constitutive du groupement.

II. – Le directeur de l’établissement support peut déléguer sa signature aux agents recrutés par cet établissement ou mis à sa disposition pour assurer les activités, fonctions et missions mentionnées à l’article L. 6132-3.

III. – Les personnels des hôpitaux des armées associés au groupement hospitalier de territoire ne peuvent pas être nommés par l’établissement support du groupement pour assurer les activités, fonctions et missions mentionnées au I pour le compte des établissements parties au groupement. Ils peuvent contribuer à la réalisation de ces activités ou missions dans des conditions prévues par la convention constitutive.
