Article R6143-13 of the French Public Health Code

Members of the Supervisory Boards who fall under the incompatibilities or incapacities provided for in article L. 6143-6 shall resign from their office. Failing this, they shall be declared to have resigned automatically by the Director General of the Regional Health Agency.

Any member who, without legitimate reason, fails to attend Supervisory Board meetings for a period of one year is deemed to have resigned. The Director General of the Regional Health Agency shall record this resignation and notify the member concerned, who shall be replaced within one month of this notification.

If a member ceases to hold office before the expiry of his term of office, he shall be replaced within three months under the same conditions. In this case, the new member’s term of office ends on the date on which that of the member he has replaced would have ended.

Les membres des conseils de surveillance qui tombent sous le coup des incompatibilités ou incapacités prévues à l’article L. 6143-6 démissionnent de leur mandat. A défaut, ils sont déclarés démissionnaires d’office par le directeur général de l’agence régionale de santé.

Tout membre qui, sans motif légitime, s’abstient pendant un an d’assister aux séances du conseil de surveillance est réputé démissionnaire. Le directeur général de l’agence régionale de santé constate cette démission et la notifie à l’intéressé, qui est remplacé dans un délai d’un mois à compter de cette notification.

Si un membre cesse ses fonctions avant l’expiration de son mandat, il est pourvu, dans le délai de trois mois, à son remplacement dans les mêmes conditions. Dans ce cas, le mandat du nouveau membre prend fin à la date où aurait cessé celui du membre qu’il a remplacé.
