Article R6147-122 of the French Public Health Code

I.-The term of office for mediators and representatives of patients and their relatives is set at three years, renewable.

II.-In compliance with the conditions set out inarticle L. 122-1 of the Code of Relations between the Public and the Administration, the Chief Medical Officer of the Armed Forces Hospital may terminate the term of office of a member of the Users’ Commission for a legitimate reason, in particular when the behaviour of the member concerned proves incompatible with access to the Armed Forces Hospital or with access to protected data.

III – For the implementation of the sixth paragraph of article L. 1112-3 of the present code relating to access to medical data, the members of the Users’ Commission are bound by professional secrecy under the conditions defined in articles 226-13 and 226-14 of the French Penal Code. They must also exercise professional discretion with regard to all other facts, information or documents of which they become aware in the course of their involvement in the governance of the hospital.

I.-La durée du mandat des médiateurs et des représentants des patients et de leurs proches est fixée à trois ans renouvelables.

II.-Dans le respect des conditions prévues à l’article L. 122-1 du code des relations entre le public et l’administration, le médecin-chef de l’hôpital des armées peut mettre fin au mandat d’un membre de la commission des usagers pour motif légitime, notamment lorsque le comportement du membre concerné s’avère incompatible avec l’accès à l’hôpital des armées ou avec l’accès à des données protégées.

III.-Pour la mise en œuvre du sixième alinéa de l’article L. 1112-3 du présent code relatif à l’accès aux données médicales, les membres de la commission des usagers sont astreints au secret professionnel dans les conditions définies aux articles 226-13 et 226-14 du code pénal. Ils doivent en outre faire preuve de discrétion professionnelle pour tous les autres faits, informations ou documents dont ils ont connaissance à l’occasion de leur participation à la gouvernance de l’hôpital.
