Article R6147-78 of the French Public Health Code

The members representing the staff are appointed for a period of three years, from among the permanent staff, by the most representative trade union organisations in proportion to the average number of votes received by each of these organisations on the occasion of the renewal of the local joint committees, with the remaining votes being distributed on the basis of the highest average.

When there is no trade union organisation in the establishment, the staff representatives are elected from among the permanent staff by all the permanent and probationary staff in a majority ballot with one round.

Les membres représentant le personnel sont désignés pour une durée de trois ans, parmi le personnel titulaire, par les organisations syndicales les plus représentatives proportionnellement au nombre de voix moyen recueilli par chacune de ces organisations à l’occasion du renouvellement des commissions paritaires locales avec répartition des restes à la plus forte moyenne.

Lorsqu’il n’existe pas d’organisation syndicale dans l’établissement, les représentants du personnel sont élus parmi le personnel titulaire par l’ensemble des personnels titulaires et stagiaires au scrutin majoritaire à un tour.
