Article R6148-2 of the French Public Health Code

Provided that the transaction is sustainable in terms of its impact on public finances and on the financial situation of the public entity, the leasing contract referred to in article L. 6148-7-1 is entered into by the Director General of the Regional Health Agency on behalf of the State on behalf of the public health institution and by the Minister for Health on behalf of the health cooperation structure with public legal personality.

From the date of signature of the contract, the public health establishment or the health cooperation structure with public legal personality assumes all the rights and obligations attached to it.

Article R6148-2

Sous réserve que l’opération soit soutenable au regard de ses conséquences sur les finances publiques et sur la situation financière de la personne publique, le contrat de crédit-bail mentionné à l’article L. 6148-7-1 est conclu par le directeur général de l’agence régionale de santé au nom de l’Etat pour le compte de l’établissement public de santé et par le ministre chargé de la santé pour le compte de la structure de coopération sanitaire dotée de la personnalité morale publique.

A compter de la signature du contrat, l’établissement public de santé ou la structure de coopération sanitaire dotée de la personnalité morale publique assume la totalité des droits et obligations qui y sont attachés.
