Article R615-34 of the French Intellectual Property Code

For disputes involving the civil servants and agents referred to in article R. 611-11 and the natural persons referred to in article R. 611-22, a special list is drawn up from which the two assessors of the chairman of the joint conciliation commission are chosen for each case.

Subject to the provisions of the last paragraph of this article, this list shall include persons registered on the proposal, on the one hand, of the ministers and, on the other hand, of the organisations representing the staff.

The list of these organisations shall be fixed by order of the Prime Minister on the proposal of the various ministers.

One of the assessors is chosen from among the persons proposed by the aforementioned organisations, the other from among the persons proposed by the ministers.

When the invention has been made by a staff member subject to the general status of military personnel, the assessor representing the staff member shall be appointed by the chairman of the conciliation commission from a list of five members of the military corps of the Contrôle Général des Armées drawn up by the head of the Contrôle Général des Armées and periodically updated.

Pour ce qui concerne les litiges intéressant les fonctionnaires et agents visés à l’article R. 611-11 et les personnes physiques visées à l’article R. 611-22, il est établi une liste spéciale sur laquelle sont choisis pour chaque affaire les deux assesseurs du président de la commission paritaire de conciliation.

Sous réserve des dispositions du dernier alinéa du présent article, cette liste comprend des personnes inscrites sur proposition, d’une part, des ministres, d’autre part, des organisations représentant le personnel.

La liste de ces organisations est fixée par arrêté du Premier ministre sur proposition des différents ministres.

L’un des assesseurs est choisi parmi les personnes proposées par les organisations précitées, l’autre parmi les personnes proposées par les ministres.

Lorsque l’invention a été réalisée par un agent soumis au statut général des militaires, il est procédé à la désignation de l’assesseur représentant l’agent, par le président de la commission de conciliation, sur une liste de cinq membres du corps militaire du contrôle général des armées établie par le chef du contrôle général des armées et périodiquement mise à jour.
