Article R616-1 of the French Intellectual Property Code

From the day of publication, provided for in Article R. 612-39, the application for the utility certificate mentioned in Article L. 611-2, and until payment of the fee for issuing and printing the fascicle of this certificate, any person may send observations on the patentability of the invention to the Institut national de la propriété industrielle, in the form provided for patent applications to article R. 612-63, paragraph 2.

The content of these observations is notified, without delay, to the applicant, who has a period of three months to respond.

Article R616-1

A compter du jour de la publication, prévue à l’article R. 612-39, de la demande du certificat d’utilité mentionné à l’article L. 611-2, et jusqu’au paiement de la redevance de délivrance et d’impression du fascicule de ce certificat, toute personne peut adresser à l’Institut national de la propriété industrielle des observations sur la brevetabilité de l’invention, dans les formes prévues en matière de demande de brevet à l’article R. 612-63, alinéa 2.

La teneur de ces observations est notifiée, sans délai, au demandeur qui dispose d’un délai de trois mois pour y répondre.
