A medical committee, attached to each prefect, is responsible for giving an opinion on the physical and mental fitness of practitioners governed by these regulations to carry out their duties, as well as on any medical issue of interest to them for the application of the provisions of these regulations.
The matter is referred to the committee either by the director general of the regional health agency, or by the director of the health establishment after obtaining the opinion of the chairman of the establishment’s medical committee, or by the director general of the Centre national de gestion.
The practitioner whose case is submitted to a medical committee is obliged to appear before it and, if so requested, to provide it with the medical documents concerning him. He may ask to be heard by one or more doctors of his choice, who shall have access to the file compiled by the committee.
The committee is made up of three members appointed, when each case is examined, by order of the Prefect on the recommendation of the Director General of the Regional Health Agency, from among tenured teaching and hospital staff and hospital practitioners governed by this section.
