Article R6152-36 of the French Public Health Code

A medical committee, attached to each prefect, is responsible for giving an opinion on the physical and mental fitness of practitioners governed by these regulations to carry out their duties, as well as on any medical issue of interest to them for the application of the provisions of these regulations.

The matter is referred to the committee either by the director general of the regional health agency, or by the director of the health establishment after obtaining the opinion of the chairman of the establishment’s medical committee, or by the director general of the Centre national de gestion.

The practitioner whose case is submitted to a medical committee is obliged to appear before it and, if so requested, to provide it with the medical documents concerning him. He may ask to be heard by one or more doctors of his choice, who shall have access to the file compiled by the committee.

The committee is made up of three members appointed, when each case is examined, by order of the Prefect on the recommendation of the Director General of the Regional Health Agency, from among tenured teaching and hospital staff and hospital practitioners governed by this section.

Un comité médical, placé auprès de chaque préfet, est chargé de donner un avis sur l’aptitude physique et mentale des praticiens régis par le présent statut à exercer leurs fonctions, ainsi que sur toute question d’ordre médical les intéressant pour l’application des dispositions du présent statut.

Le comité est saisi soit par le directeur général de l’agence régionale de santé, soit par le directeur de l’établissement de santé après avis du président de la commission médicale d’établissement, soit par le directeur général du Centre national de gestion.

Le praticien dont le cas est soumis à un comité médical est tenu de se présenter devant lui et, si la demande lui en est faite, de lui communiquer les pièces médicales le concernant. Il peut demander que soient entendus un ou plusieurs médecins de son choix, qui ont accès au dossier constitué par le comité.

Le comité comprend trois membres désignés, lors de l’examen de chaque dossier, par arrêté du préfet sur proposition du directeur général de l’agence régionale de santé, parmi des membres du personnel enseignant et hospitalier titulaires et les praticiens hospitaliers régis par la présente section.
