Article R6152-42 of the French Public Health Code

When, at the end of one year’s leave granted in application of articles R. 6152-37 to R. 6152-41, the practitioner is unable to resume his duties, his post is declared vacant.

A practitioner who, at the end of a period of leave granted in application of articles R. 6152-37 to R. 6152-41, is declared fit to resume his duties shall be reinstated in the post he occupied at the time he was placed on leave or, if this post is filled, in another post in the establishment or in another establishment in the health territory. Failing this, he shall be reinstated in surplus.

A practitioner who, on expiry of his entitlement to leave under articles R. 6152-37 to R. 6152-41, is recognised to be definitively unfit, following the opinion of the medical committee, is placed on availability. He loses the benefit of the present statute on the effective date of his invalidity pension.

Lorsqu’à l’issue d’un an de congés accordés en application des articles R. 6152-37 à R. 6152-41, le praticien ne peut reprendre ses fonctions, son poste est déclaré vacant.

Le praticien qui à l’issue d’un congé accordé en application des articles R. 6152-37 à R. 6152-41 est déclaré apte à reprendre ses fonctions réintègre le poste qu’il occupait au moment de son placement en congé ou, si celui-ci est pourvu, un autre poste dans l’établissement ou dans un autre établissement du territoire de santé. A défaut, il est réintégré en surnombre.

Le praticien qui, à l’expiration de ses droits à congés au titre des articles R. 6152-37 à R. 6152-41, est reconnu définitivement inapte, après avis du comité médical, est placé en disponibilité. Il perd le bénéfice du présent statut à la date d’effet de sa pension d’invalidité.
