When, at the end of one year’s leave granted in application of articles R. 6152-37 to R. 6152-41, the practitioner is unable to resume his duties, his post is declared vacant.
A practitioner who, at the end of a period of leave granted in application of articles R. 6152-37 to R. 6152-41, is declared fit to resume his duties shall be reinstated in the post he occupied at the time he was placed on leave or, if this post is filled, in another post in the establishment or in another establishment in the health territory. Failing this, he shall be reinstated in surplus.
A practitioner who, on expiry of his entitlement to leave under articles R. 6152-37 to R. 6152-41, is recognised to be definitively unfit, following the opinion of the medical committee, is placed on availability. He loses the benefit of the present statute on the effective date of his invalidity pension.
