The doctors, odontologists and pharmacists mentioned in 2° of article L. 6152-1 may be recruited as hospital assistants under the conditions defined by this section:
1° In public health establishments ;
2° In the public establishments mentioned in I of article L. 313-12 of the Code de l’action sociale et des familles.
They may carry out their activities in several establishments, within the “groupements hospitaliers de territoire” mentioned in article L. 6132-1 or in order to promote the cooperative actions mentioned in article L. 6134-1. In this case, an agreement signed between the establishments, with the agreement of the practitioner concerned and after obtaining the opinion of the head of the department and the chairman of the establishment medical committee of the establishments concerned, as well as the medical committees of the establishments concerned, determines the procedures for distributing the assistant’s work and the fraction of the emoluments, allowances and benefits provided for in article R. 6152-514 and the costs borne by each of the establishments. Practitioners working full-time benefit from the arrangement mentioned in article R. 6152-4-1. Practitioners who do not work full time may benefit from this scheme by decision of the Director General of the Regional Health Agency taken on a proposal from the Director of the establishment. An order of the Minister for Health specifies the conditions for application of these provisions.
The provisions of this section, which require consultation with the establishment’s medical committee, its chairman, the head of the division or, failing that, the head of the department, the head of the functional unit or any other internal structure, do not apply to assistants who carry out their duties in the public establishments mentioned in I of article L. 313-12 of the code de l’action sociale et des familles.
