Article R6152-53 of the French Public Health Code

A practitioner called upon to perform the duties of a member of the government or a parliamentary mandate is automatically seconded for the duration of these duties or mandate.

A practitioner seconded to a post as general advisor to health establishments is seconded automatically for the duration of the contract.

In these cases, the opinions of the head of the department, the chairman of the establishment’s medical committee and the director are not required.

Le praticien appelé à exercer des fonctions de membre du gouvernement ou un mandat parlementaire est détaché de droit pour la durée de ces fonctions ou de ce mandat.

Le praticien détaché sur un emploi de conseiller général des établissements de santé est détaché de droit pour la durée du contrat.

Dans ces cas, les avis du chef de pôle, du président de la commission médicale d’établissement et du directeur ne sont pas requis.
