Article R6152-530 of the French Public Health Code

The disciplinary sanctions applicable to assistants are :

1° A warning ;

2° a reprimand

3° Suspension for a period not exceeding six months, with total or partial loss of remuneration;

4° dismissal.

The warning and reprimand are pronounced by the director of the establishment after obtaining the opinion of the establishment’s medical committee. Other sanctions are pronounced by the Director General of the Regional Health Agency, after obtaining the opinion of the establishment’s medical committee and the director of the establishment.

In the absence of an opinion from the hospital medical committee within two months of it being convened, only the opinion of its chairman is required.

Les sanctions disciplinaires applicables aux assistants sont :

1° L’avertissement ;

2° Le blâme ;

3° La suspension pour une durée ne pouvant excéder six mois, avec suppression totale ou partielle des émoluments ;

4° Le licenciement.

L’avertissement et le blâme sont prononcés par le directeur de l’établissement après avis de la commission médicale d’établissement. Les autres sanctions sont prononcées par le directeur général de l’agence régionale de santé, après avis de la commission médicale d’établissement et du directeur de l’établissement.

A défaut d’avis rendu par la commission médicale d’établissement dans les deux mois de sa convocation, seul l’avis de son président est requis.
