Article R6152-54 of the French Public Health Code

Subject to the provisions of article R. 6152-53, compulsory secondment may only be granted when the interests of the service so require, to a post of hospital practitioner in the same discipline and with equivalent remuneration, in one of the establishments mentioned in article R. 6152-1.

The compulsory secondment is decided by the Director General of the Centre National de Gestion, after obtaining the opinion of the head of the department, the head of the service, the chairman of the establishment’s medical commission and the director, for a maximum period of five years, renewable for the same period by tacit agreement.

The compulsory secondment ends when the practitioner’s status is changed or when he is appointed, under the conditions provided for in article R. 6152-7, to a hospital practitioner post.

Article R6152-54

Sous réserve des dispositions de l’article R. 6152-53, le détachement d’office ne peut être prononcé que lorsque l’intérêt du service l’exige sur un emploi de praticien hospitalier de même discipline et comportant une rémunération équivalente, dans l’un des établissements mentionnés à l’article R. 6152-1.

Le détachement d’office est prononcé par le directeur général du Centre national de gestion, après avis du chef de pôle, du chef de service, du président de la commission médicale d’établissement et du directeur, pour une période maximale de cinq ans renouvelable, pour la même durée, par tacite reconduction.

Le détachement d’office prend fin lorsque la situation statutaire du praticien est modifiée ou lorsqu’il est nommé, dans les conditions prévues à l’article R. 6152-7, sur un poste de praticien hospitalier.
