Article R6152-59 of the French Public Health Code

On expiry of his secondment, the practitioner is reinstated :

1° Either, by right, to his post if the period of secondment has not exceeded six months or one year if the practitioner was seconded pursuant to 3° of article R. 6152-51 ;

2° Or to his post if it is still vacant, by decision of the Director General of the Centre National de Gestion after receiving a favourable opinion from the Director, the Head of the Division, the Head of Department and the Chairman of the Institutional Medical Commission;

3° Or to another post in the same discipline, in accordance with the provisions of the second paragraph of article R. 6152-7, if the post occupied by the practitioner has been filled.

A seconded practitioner who has applied for reinstatement but is unable to obtain it is placed on compulsory leave under the conditions laid down in article R. 6152-63.

A seconded practitioner who refuses three offers of a post may be struck off the register by the Director General of the Centre National de Gestion after receiving the opinion of the national statutory commission.

A l’expiration de son détachement, le praticien est réintégré :

1° Soit, de droit, dans son poste si la durée de détachement n’a pas excédé six mois ou un an si le praticien était détaché en application du 3° de l’article R. 6152-51 ;

2° Soit sur son poste s’il est toujours vacant, par décision du directeur général du Centre national de gestion après avis favorable du directeur, du chef de pôle, du chef de service et du président de la commission médicale d’établissement ;

3° Soit dans un autre poste de même discipline, conformément aux dispositions du deuxième alinéa de l’article R. 6152-7, si le poste qu’occupait le praticien a été pourvu.

Le praticien détaché qui, ayant sollicité sa réintégration, n’a pu l’obtenir est placé en disponibilité d’office dans les conditions fixées à l’article R. 6152-63.

Le praticien détaché qui refuse trois propositions de poste peut être rayé des cadres par le directeur général du Centre national de gestion après avis de la commission statutaire nationale.
