Article R6152-920 of the French Public Health Code

The associate practitioner may benefit from therapeutic part-time work allowing him to gradually return to his duties in the event of an improvement in his state of health, following a favourable opinion from the medical committee mentioned in article R. 6152-36, under the following conditions:

1° The associate practitioner may be authorised to work part-time on a therapeutic basis :

a) After long-term sick leave or long-term leave of absence, for a period of three months renewable up to a maximum of one year for each condition for which long-term sick leave or long-term leave of absence is granted;

b) After leave for an accident in the line of duty or a disease contracted in the line of duty, for a maximum period of six months, renewable once;

2° Therapeutic part-time work may be granted :

a) Either because resuming part-time work is recognised as being likely to improve the state of health of the person concerned;

b) or because the person concerned must undergo re-education or readaptation to his duties, compatible with his state of health;

3° Associate practitioners authorised to work part-time for therapeutic reasons receive the full emoluments provided for in 1° of article R. 6152-912.

An associate practitioner who is entitled to work part-time for therapeutic reasons may, at his request, be exempted from performing on-call duty, after receiving the opinion of the occupational physician.

Le praticien associé peut bénéficier d’un temps partiel thérapeutique lui permettant de reprendre progressivement ses fonctions en cas d’amélioration de son état de santé après avis favorable du comité médical mentionné à l’article R. 6152-36, dans les conditions suivantes :

1° Le praticien associé peut être autorisé à accomplir un temps partiel thérapeutique :

a) Après un congé de longue maladie ou de longue durée, pour une période de trois mois renouvelable dans la limite d’un an par affection ayant ouvert droit à un congé de longue maladie ou de longue durée ;

b) Après un congé pour accident de service ou maladie contractée dans l’exercice de ses fonctions, pour une période maximale de six mois renouvelable une fois ;

2° Le temps partiel thérapeutique peut être accordé :

a) Soit parce que la reprise des fonctions à temps partiel est reconnue comme étant de nature à favoriser l’amélioration de l’état de santé de l’intéressé ;

b) Soit parce que l’intéressé doit faire l’objet d’une rééducation ou d’une réadaptation à ses fonctions, compatible avec son état de santé ;

3° Les praticiens associés autorisés à travailler à temps partiel pour raison thérapeutique perçoivent la totalité des émoluments prévus au 1° de l’article R. 6152-912.

Le praticien associé qui bénéficie d’un temps partiel thérapeutique peut, à sa demande, être dispensé d’effectuer des gardes et astreintes, après avis du médecin du travail.
