Article R6153-44 of the French Public Health Code

The provisions of the second and third paragraphs of article R. 6153-2 and those of articles R. 6153-3 to R. 6153-7, R. 6153-12 to R. 6153-19 and R. 6153-21 to R. 6153-24 apply to students acting as interns and former residents who complete one or two additional semesters in public health establishments.

The provisions of articles R. 6153-29 to R. 6153-40 apply to students acting as interns mentioned in 1° and 2° of article R. 6153-40 and to former residents mentioned in article R. 6153-43. In the event that the Disciplinary Board provided for in article R. 6153-32 meets to examine the case of a student acting as an intern or a former resident, the six interns or residents who sit respectively in the first and second sections mentioned in this same article are replaced in equal numbers by students acting as interns or former residents proposed under the same conditions or, in the absence of such proposals, drawn by lot from among the students acting as interns or residents in post in the region. The procedures for this drawing of lots are laid down by order of the ministers responsible for higher education and health.

The provisions of article R. 6153-10, with the exception of the last four paragraphs and 3° of article D. 6153-10-1, are applicable to them.

However, the fixed monthly emoluments mentioned in 1° of article R. 6153-10 do not vary, for students acting as interns, according to their seniority.

Students appointed as interns at the end of the third cycle retain the emoluments they received during their last year in the cycle.

Les dispositions du deuxième et troisième alinéas de l’article R. 6153-2 et celles des articles R. 6153-3 à R. 6153-7, R. 6153-12 à R. 6153-19 et R. 6153-21 à R. 6153-24 sont applicables aux étudiants faisant fonction d’interne et aux anciens résidents qui accomplissent un ou deux semestres supplémentaires dans les établissements publics de santé.

Les dispositions des articles R. 6153-29 à R. 6153-40 s’appliquent aux étudiants faisant fonction d’interne mentionnés au 1° et au 2° de l’article R. 6153-40 et aux anciens résidents mentionnés à l’article R. 6153-43. Dans le cas où le conseil de discipline prévu à l’article R. 6153-32 se réunit afin d’examiner le cas d’un étudiant faisant fonction d’interne ou d’un ancien résident, les six internes ou résidents qui siègent respectivement à la première et à la deuxième section mentionnées à ce même article sont remplacés en nombre égal par des étudiants faisant fonction d’interne ou d’anciens résidents proposés dans les mêmes conditions ou, à défaut de telles propositions, tirés au sort parmi les étudiants faisant fonction d’interne ou les résidents en poste dans la région. Les modalités de ce tirage au sort sont fixées par arrêté des ministres chargés de l’enseignement supérieur et de la santé.

Les dispositions de l’article R. 6153-10, à l’exception des quatre derniers alinéas et du 3° de l’article D. 6153-10-1, leur sont applicables.

Toutefois, les émoluments forfaitaires mensuels mentionnés au 1° de l’article R. 6153-10 ne varient pas, pour les étudiants faisant fonction d’interne, en fonction de leur ancienneté.

Les étudiants nommés faisant fonction d’interne à l’issue du troisième cycle conservent le bénéfice du montant des émoluments qu’ils perçoivent au cours de leur dernière année dans le cycle.
