Article R621-3 of the French Commercial code

The court’s decision to appoint a judge, before ruling, pursuant to Article L. 621-1, to gather all the information on the financial, economic and social situation of the company, is rendered under the same conditions as those provided for in the first two paragraphs of the same article, for the opening of the proceedings.

The report of this judge, to which the expert’s report is annexed, where one has been appointed, is filed at the registry and communicated by the registrar to the debtor and the public prosecutor.

The registrar informs the social and economic committee that their representatives may examine the report at the registry and at the same time notifies them of the date of the hearing.

Article R621-3

La décision du tribunal de commettre un juge, avant de statuer, en application de l’article L. 621-1, pour recueillir tous les renseignements sur la situation financière, économique et sociale de l’entreprise, est rendue dans les mêmes conditions que celles prévues aux deux premiers alinéas du même article, pour l’ouverture de la procédure.

Le rapport de ce juge, auquel est annexé le rapport de l’expert, lorsqu’il en a été désigné, est déposé au greffe et communiqué par le greffier au débiteur et au ministère public.

Le greffier informe le comité social et économique que leurs représentants peuvent prendre connaissance du rapport au greffe et l’avise en même temps de la date de l’audience.
