Article R621-4 of the French Commercial code

The court shall rule, where appropriate, on the report of the judge assigned to the case. The judge may not sit or take part in the deliberations. If the judgment cannot be rendered immediately, the pronouncement is postponed to a future hearing, the date of which is communicated to the debtor at the hearing.

The judgment opening the proceedings takes effect from its date.

Le tribunal statue, le cas échéant, sur le rapport du juge commis. Celui-ci ne peut siéger ni participer au délibéré. Si le jugement ne peut être rendu sur-le-champ, le prononcé en est renvoyé à une prochaine audience dont la date est communiquée, lors de l’audience, au débiteur.

Le jugement d’ouverture de la procédure prend effet à compter de sa date.
