Article R623-22 of the French Intellectual Property Code

In the event that the proposed denomination is recognised by the person in charge of the tasks falling within the remit of the national plant variety authority as not complying with the provisions of articles R. 623-6 and R. 623-7 and of the orders made for the application of this section, or is the subject of observations recognised as valid by the person in charge of the tasks falling within the remit of the national plant variety authority, the breeder is invited to submit a new denomination within a period of two months from the notification made to him. This new denomination is subject to the same investigation and publication measures. If the breeder does not propose a new denomination within this period, the application for a certificate is declared inadmissible. Fees already paid will not be refunded.

Dans le cas où la dénomination proposée est reconnue par le responsable des missions relevant de l’instance nationale des obtentions végétales comme n’étant pas conforme aux dispositions des articles R. 623-6 et R. 623-7 et des arrêtés pris pour l’application de la présente section, ou fait l’objet d’observations reconnues valables par le responsable des missions relevant de l’instance nationale des obtentions végétales, l’obtenteur est invité à présenter une nouvelle dénomination dans un délai de deux mois à compter de la notification qui lui est faite. Cette nouvelle dénomination donne lieu aux mêmes mesures d’instruction et de publication. Dans le cas où l’obtenteur ne propose pas une nouvelle dénomination dans ce délai, la demande de certificat est déclarée irrecevable. Les redevances déjà perçues ne sont pas restituées.
