Article R623-23 of the French Intellectual Property Code

Investigation is suspended at the written request of any person who provides proof that he has brought an action before the judicial court or, in the overseas territories, the court of first instance to claim ownership of the application for a plant variety certificate. However, tests decided by the person in charge of the missions under the national plant variety authority may be carried out.

The investigation is resumed as soon as the court’s decision has become final. It may also be resumed at any time with the written consent of the person who brought the claim action. This consent is then irrevocable. During this period, the holder of the claim may not withdraw it without the consent of the person who brought the claim. In addition, the claimant is called upon to take part in the investigation in the same way as the holder of the claim.

L’instruction est suspendue à la requête écrite de toute personne qui apporte la preuve qu’elle a intenté auprès du tribunal judiciaire ou, dans les territoires d’outre-mer, du tribunal de première instance une action en revendication de la propriété de la demande de certificat d’obtention végétale. Toutefois, les essais décidés par le responsable des missions relevant de l’instance nationale des obtentions végétales peuvent être effectués.

L’instruction est reprise dès que la décision du tribunal est passée en force de chose jugée. Elle peut être également reprise à tout moment sur le consentement écrit de la personne qui a intenté l’action en revendication. Ce consentement est alors irrévocable. Pendant cette période, le titulaire de la demande ne peut retirer celle-ci sans le consentement de l’auteur de l’action en revendication. De plus, celui-ci est appelé à participer à l’instruction au même titre que le titulaire de la demande.
