The registration of plant variety certificates in the National Register of Plant Variety Certificates takes place in the order of their issue.
The registration includes:
the serial number under which the certificate was issued;
the genus or species to which the variety belongs;
the denomination and, where appropriate, any other denomination under which it is already designated by other members of the International Union for the Protection of New Varieties of Plants;
-a botanical description;
-the name and address of the owner of the plant variety certificate and the name and address of the breeder if the latter is not the owner of the plant variety certificate;
-if applicable, the priority claim;
-the dates on which protection commences and expires and, if applicable, the anticipated renunciation or the decision recording the lapse of the owner’s rights.
This entry is supplemented, where applicable, by a reference to court decisions determining the owner of the right.
It is also supplemented by mention of all acts relating to the transfer of ownership of the breeder’s right, the assignment or grant of a right of exploitation, the ex officio licence and all acts transferring or modifying the rights attached to a plant variety certificate including, where applicable, those relating to the recognition of essentially derived varieties within the meaning of IV of Article L. 623-4. These various additional registrations will be made in return for payment of royalties.
