Article R623-7 of the French Intellectual Property Code

If the variety has already been the subject of an application for protection in another State with a member of the International Union for the Protection of New Varieties of Plants and if a denomination has been accepted by that member, that denomination must obligatorily be used in France to designate the said variety, unless it has been the subject of observations recognised as justified under the conditions laid down in the articles R. 623-17 to R. 623-26 or that the person in charge of the tasks falling within the remit of the national plant variety authority has established that it is not suitable for use in territories where the legislation on the protection of new plant varieties is applicable or that the name does not comply with the requirements of the first paragraph of Article R. 623-6.

Article R623-7

Dans le cas où la variété a déjà fait l’objet d’une demande de protection dans un autre Etat auprès d’un membre de l’Union internationale pour la protection des obtentions végétales et si une dénomination a été acceptée par ce membre, cette dénomination doit obligatoirement être utilisée en France pour désigner ladite variété, à moins qu’elle n’ait fait l’objet d’observations reconnues justifiées dans les conditions prévues par les articles R. 623-17 à R. 623-26 ou que soit constaté par le responsable des missions relevant de l’instance nationale des obtentions végétales sa non-convenance sur les territoires où la législation relative à la protection des obtentions végétales est applicable ou que la dénomination ne soit pas conforme aux prescriptions du premier alinéa de l’article R. 623-6.
