Article R631-2 of the French Monetary and Financial Code

I. – In cases other than those mentioned in Article R. 631-1, the draw provided for in the penultimate paragraph of Article L. 631-2 is carried out by the Governor of the Banque de France, assisted by two persons whom he chooses from among his staff, in the presence of representatives of the Presidents of the National Assembly and the Senate and of the Minister for the Economy, appointed by the latter.

II. – Three ballot papers are drawn up for the purpose of the draw. If the majority of the members of the Haut Conseil de stabilité financière mentioned in 1° to 4° of Article L. 631-2 are men, two ballots shall be marked “woman” and one “man”. Otherwise, two ballot papers are marked “man” and one “woman”.

The first ballot paper drawn by lot shall indicate the gender of the person to be appointed by the President of the National Assembly.

The second ballot paper drawn indicates the gender of the person to be appointed by the President of the Senate.

The remaining ballot paper indicates the gender of the person to be appointed by the Minister for the Economy.

III. – The drawing of lots is recorded in minutes signed by the Governor of the Banque de France and the two persons who assisted him. The minutes are sent to the presidents of the National Assembly and the Senate and to the Minister for the Economy.

Article R631-2

I. – Dans les cas autres que ceux mentionnés à l’article R. 631-1, le tirage au sort prévu à l’avant-dernier alinéa de l’article L. 631-2 est effectué par le gouverneur de la Banque de France, assisté de deux personnes qu’il choisit au sein de ses services, en présence de représentants des présidents de l’Assemblée nationale et du Sénat ainsi que du ministre chargé de l’économie, désignés par ces derniers.

II. – Afin de procéder au tirage au sort, sont établis trois bulletins. Dans le cas où les membres du Haut Conseil de stabilité financière mentionnés aux 1° à 4° de l’article L. 631-2 sont majoritairement des hommes, deux bulletins portent la mention : ” femme ” et un porte la mention : ” homme “. Dans le cas contraire, deux bulletins portent la mention : ” homme ” et un porte la mention : ” femme “.

Le premier bulletin tiré au sort indique le sexe de la personne à nommer par le président de l’Assemblée nationale.

Le deuxième bulletin tiré au sort indique le sexe de la personne à nommer par le président du Sénat.

Le bulletin restant indique le sexe de la personne à nommer par le ministre chargé de l’économie.

III. – Les opérations de tirage au sort font l’objet d’un procès-verbal signé par le gouverneur de la Banque de France et les deux personnes l’ayant assisté. Le procès-verbal est transmis aux présidents de l’Assemblée nationale et du Sénat ainsi qu’au ministre chargé de l’économie.
