In the event of the transfer of the operation, including where this is the result of a merger or amalgamation, the transferee, before commencing operation on its own behalf, must send the Director General of the Regional Health Agency, in accordance with the procedures laid down in the first paragraph of Article R. 6322-3, an application for confirmation of the authorisation, accompanied by the file provided for in Article R. 6322-4 as required for an application for renewal and showing, where appropriate, the changes it intends to make to the facilities or their operation.
The application must also include a document signed by the transferor or his legal representative, certifying the transfer, or a copy of the deed or promise of sale.
The Director General of the Regional Health Agency decides on the application in the same way as for an application for authorisation.
Confirmation of the authorisation may only be refused if the dossier submitted by the transferee shows changes that would justify refusal of renewal in application of article R. 6322-8.
