The successful bidder shall have the auction deed or judgement published at the land registry within two months of its date and, in the event of an appeal, within two months of the confirmatory judgement, failing which the auction shall be repeated at the behest of the liquidator.
Within three months of the auction, the successful bidder shall pay into the deposit account opened by the liquidator at the Caisse des Dépôts et Consignations the entire auction price, including interest at the legal rate from the day on which the sale became final until the day of payment. After this deadline, the liquidator shall enjoin the buyer by registered letter with acknowledgement of receipt to make the payment, failing which the auction will be repeated.
In the case of a private sale, the notary in charge of the sale remits the price, as soon as it has been collected, to the liquidator.
The sale price may not be subject to any deduction by the liquidator until the purchaser provides proof that he has completed the purging procedure or that he has obtained dispensation from the registered creditors to do so.
In the event of an overbid, the price is returned without delay to the purchaser by the liquidator, through the intermediary of the notary.
