Article R651-5 of the French Commercial code

For the application of article L. 651-4, the judge appointed by the president of the court may be assisted by any person of his choice, whose findings are recorded in his report. This report is filed at the court registry and communicated by the court clerk to the public prosecutor. At least one month before the date of the hearing, the clerk of the court communicates this report to the managers or the entrepreneur in question by registered letter with acknowledgement of receipt.

The court rules on the report of the designated judge after hearing or duly calling the auditors.

The amount of the sums for the guarantee of which the protective measure is ordered in accordance with the second paragraph of article L. 651-4 may not exceed the amount of the claim made against the manager or entrepreneur.

Pour l’application de l’article L. 651-4, le juge désigné par le président du tribunal peut se faire assister de toute personne de son choix dont les constatations sont consignées dans son rapport. Ce rapport est déposé au greffe et communiqué par le greffier au ministère public. Au moins un mois avant la date de l’audience, le greffier communique ce rapport aux dirigeants ou à l’entrepreneur mis en cause par lettre recommandée avec demande d’avis de réception.

Le tribunal statue sur le rapport du juge désigné après avoir entendu ou dûment appelé les contrôleurs.

Le montant des sommes pour la garantie desquelles la mesure conservatoire est ordonnée conformément au deuxième alinéa de l’article L. 651-4 ne peut excéder le montant de la demande formée à l’encontre du dirigeant ou de l’entrepreneur.
