Article R6523-20 of the French Labour Code

In order to obtain the same number of representatives, on the one hand, of the trade union organisations and, on the other hand, of the professional organisations plus the representatives of the consular networks, the prefect may appoint additional representatives of a trade union or professional organisation. Depending on the case, the additional seats are allocated to the employees’ trade union organisations that obtained the best results in the audience measurement carried out in application of the provisions of Chapter II of Title II of Book I of Part Two or to the employers’ professional organisations whose audience measurement carried out in application of the provisions of Chapter II of Title V of Book I of Part Two is the most significant.

Afin d’obtenir le même nombre de représentants, d’une part, des organisations syndicales et, d’autre part, des organisations professionnelles augmentées des représentants des réseaux consulaires, le préfet peut nommer des représentants supplémentaires d’une organisation syndicale ou professionnelle. Selon le cas, les sièges supplémentaires sont attribués aux organisations syndicales de salariés ayant obtenu les meilleurs résultats dans le cadre de la mesure de l’audience effectuée en application des dispositions du chapitre II du titre II du livre Ier de la deuxième partie ou aux organisations professionnelles d’employeurs dont la mesure d’audience effectuée en application des dispositions du chapitre II du titre V du livre Ier de la deuxième partie est la plus importante.
