Article R6523-21 of the French Labour Code

The Regional Committee for Employment, Vocational Training and Guidance shall set up a bureau comprising :

1° Three representatives of the State, including the Regional Prefect, the Academic Regional Rector and a State representative appointed by the Regional Prefect from among those mentioned in 1° of article R. 6523-19.

2° Three representatives of the local and regional authorities responsible for vocational training and guidance, as follows :

a) In Guadeloupe and La Réunion, three representatives of the region, including the Chairman of the Regional Council and two representatives of the region designated by him from among those appointed in application of 2° of article R. 6523-19;

b) In French Guyana, three representatives of the Assembly of French Guyana, including its president and two representatives designated by him from among those appointed in application of 2° of article R. 6523-19;

c) In Martinique, three representatives of the Assembly of Martinique, including the Chairman of the Executive Council and two representatives appointed by him from among those appointed under 2° of Article R. 6523-19;

3° Four representatives of trade union organisations representing employees at national and cross-industry level or at regional and cross-industry level and professional organisations representing employers at national and cross-industry level or at regional and cross-industry level, appointed on the proposal of the college made up of all the representatives of the social partners mentioned in 3° of article R. 6523-19.

In the event that no agreement can be reached within the college mentioned in the previous paragraph within a period of one month from the date of referral to this effect of all its members by the Regional Prefect, the latter will designate two employee trade union organisations and two employer trade union organisations whose audience, measured in accordance with the provisions of Titles II and V of Book I of Part Two, is the largest.

Article R6523-21

Le comité régional de l’emploi, de la formation et de l’orientation professionnelles constitue en son sein en un bureau comprenant :

1° Trois représentants de l’Etat, dont le préfet de région, le recteur de région académique et un représentant de l’Etat désigné par le préfet de région parmi ceux mentionnés au 1° de l’article R. 6523-19.

2° Trois représentants des collectivités territoriales investies des compétences en matière de formation et d’orientation professionnelles, selon les modalités suivantes :

a) En Guadeloupe et à La Réunion, trois représentants de la région, dont le président du conseil régional et deux représentants de la région désignés par lui parmi ceux qui ont été nommés en application du 2° de l’article R. 6523-19 ;

b) En Guyane, trois représentants de l’assemblée de Guyane dont son président et deux représentants désignés par lui parmi ceux qui ont été nommés en application du 2° de l’article R. 6523-19 ;

c) En Martinique, trois représentants de l’assemblée de Martinique dont le président du conseil exécutif et deux représentants désignés par lui parmi ceux qui ont été nommés en application du 2° de l’article R. 6523-19 ;

3° Quatre représentants des organisations syndicales de salariés représentatives au plan national et interprofessionnel ou au plan régional et interprofessionnel et des organisations professionnelles d’employeurs représentatives au plan national et interprofessionnel ou représentatives au niveau régional et interprofessionnel, désignés sur proposition du collège constitué par l’ensemble des représentants des partenaires sociaux mentionnés au 3° de l’article R. 6523-19.

Dans le cas où aucun accord ne peut être obtenu au sein du collège mentionné à l’alinéa précédent dans un délai d’un mois à compter de la saisine à cet effet de tous ses membres par le préfet de région, celui-ci désigne deux organisations syndicales de salariés et deux organisations professionnelles d’employeurs dont l’audience, mesurée suivant les dispositions des titres II et V du livre Ier de la deuxième partie, est la plus forte.
