Article R663-27 of the French Commercial code

The liquidator is allocated a fee determined by an order issued pursuant to article L. 444-3 for all obligations arising from the cessation of activity of one or more classified facilities within the meaning of Title I of Book V of the Environment Code. This fee varies depending on whether:

1° The facility or facilities are subject to declaration;

2° At least one of the classified facilities is subject to authorisation or registration;

3° At least one of the classified facilities is on a list provided for in IV of Article L. 515-8 of the Environment Code.

This fee is doubled when at least one of the classified installations subject to authorisation or registration has been the subject of an order by the administrative authority prescribing emergency measures and making the site safe.

Article R663-27

Il est alloué au liquidateur un émolument déterminé par un arrêté pris en application de l’article L. 444-3 au titre de l’ensemble des obligations résultant de la cessation d’activité d’une ou de plusieurs installations classées au sens du titre Ier du livre V du code de l’environnement. Cet émolument varie selon que :

1° La ou les installations sont soumises à déclaration ;

2° L’une au moins des installations classées est soumise à autorisation ou enregistrement ;

3° L’une au moins des installations classées figure sur une liste prévue au IV de l’article L. 515-8 du code de l’environnement.

Cet émolument est doublé lorsque l’une au moins des installations classées soumises à autorisation ou à enregistrement a fait l’objet d’un arrêté de l’autorité administrative prescrivant des mesures d’urgence et de mise en sécurité du site.
