When he has approved the end-of-assignment report of the mandataire judiciaire or liquidator, the juge-commissaire proposes to the court that it apply article L. 663-3 if the conditions set out in this article are met. This proposal, which in this case it attaches to its approval decision, mentions the amount of the fees received by the court-appointed agent and is accompanied by the documents in the end-of-assignment report justifying this.
The court takes up the matter of its own motion. The decision by which it rules on the impecuniosity and fixes the amount of compensation to be paid to the judicial representative or liquidator is subject to appeal by the public prosecutor, the judicial representative and the liquidator.
