Article R712-15 of the French Intellectual Property Code

Any opposition filed after the deadline, or filed by a person who was not entitled to do so, or which does not comply with the conditions set out in articles R. 712-13 and R. 712-14, is declared inadmissible.

Where the opposition is based on several prior rights, it is declared inadmissible only if all of these rights do not comply with the conditions set out in articles R. 712-13 and R. 712-14. Otherwise, the opposition is declared admissible but deemed unfounded only in respect of those earlier rights that do not comply with those conditions.

In the event of inadmissibility noted ex officio, the Director General of the Institut National de la Propriété Industrielle will notify the grounds for inadmissibility to the opponent. The applicant is then given a period of time by the Director General in which to contest these grounds. In the absence of well-founded observations, the opposition is declared inadmissible.

Est déclarée irrecevable toute opposition soit formée hors délai, soit présentée par une personne qui n’avait pas qualité, soit non conforme aux conditions prévues aux articles R. 712-13 et R. 712-14.

Lorsque l’opposition est fondée sur plusieurs droits antérieurs, elle n’est déclarée irrecevable que si l’ensemble de ces droits ne respecte pas les conditions énoncées aux articles R. 712-13 et R. 712-14. Sinon, l’opposition est déclarée recevable mais réputée non fondée à l’égard des seuls droits antérieurs ne respectant pas ces conditions.

En cas d’irrecevabilité relevée d’office, le directeur général de l’Institut national de la propriété industrielle notifie les motifs de cette irrecevabilité à l’opposant. Un délai est alors imparti à ce dernier par le directeur général pour contester ces motifs. A défaut d’observations fondées, l’opposition est déclarée irrecevable.
