Article R712-16 of the French Intellectual Property Code

When an opposition is referred to it, the National Institute of Industrial Property shall observe and observe itself the principle of contradiction. It may not base its decision on pleas, explanations or documents put forward or produced by the parties without the latter having been given the opportunity to debate them in adversarial proceedings. The parties to the opposition are required to expressly state their claims and the factual and legal arguments on which each of their claims is based. All communications addressed to the Institute shall be made, on pain of inadmissibility, in accordance with the terms and conditions laid down by decision of the Director General of the National Institute of Industrial Property.

Lorsqu’il est saisi d’une opposition, l’Institut national de la propriété industrielle fait observer et observe lui-même le principe de la contradiction. Il ne peut fonder sa décision sur des moyens, explications et documents invoqués ou produits par les parties sans que celles-ci aient été mises à même d’en débattre contradictoirement. Toute observation ou pièce dont il est saisi par l’une des parties est notifiée sans délai à l’autre.

Les parties à l’opposition sont tenues de formuler expressément leurs demandes et les moyens de fait et de droit fondant chacune de leurs prétentions. Toutes les communications adressées à l’Institut s’effectuent, à peine d’irrecevabilité, selon les conditions et modalités fixées par décision du directeur général de l’Institut national de la propriété industrielle.
