Article R712-23 of the French Intellectual Property Code

The trade mark is registered, unless the application has been rejected or withdrawn. A certificate is sent to the applicant.

The registration is published in the Official Industrial Property Bulletin.

The date on which a trademark is deemed to be registered, in particular for the application of articles L. 712-4 and L. 714-5, is:

1° For French trademarks, that of the Bulletin officiel de la propriété industrielle in which the registration is published;

2° For international trademarks that have not been the subject of a notification of irregularity based on 2° of Article R. 712-11 or an opposition, that of the expiry of the period provided for in Article R. 717-4 or, if later, that of the expiry of the period for filing opposition;

3° For international trademarks that have been the subject of a notification of irregularity based on 2° of Article R. 712-11 or of an opposition, that, where applicable, of the entry in the International Register of Trademarks of the total or partial lifting of the refusal.

La marque est enregistrée, à moins que la demande n’ait été rejetée ou retirée. Un certificat est adressé au déposant.

L’enregistrement est publié au Bulletin officiel de la propriété industrielle.

La date à laquelle une marque est réputée enregistrée, notamment pour l’application des articles L. 712-4 et L. 714-5, est :

1° Pour les marques françaises, celle du Bulletin officiel de la propriété industrielle dans lequel l’enregistrement est publié ;

2° Pour les marques internationales n’ayant pas fait l’objet d’une notification d’irrégularité fondée sur le 2° de l’article R. 712-11 ou d’une opposition, celle de l’expiration du délai prévu à l’article R. 717-4 ou, si elle est postérieure, celle de l’expiration du délai pour former opposition ;

3° Pour les marques internationales ayant fait l’objet d’une notification d’irrégularité fondée sur le 2° de l’article R. 712-11 ou d’une opposition, celle, le cas échéant, de l’inscription au Registre international des marques de la levée totale ou partielle du refus.
