Article R712-6-1 of the French Commercial code

Collective agreements and conventions subject to approval in accordance with the first paragraph of 6° of Article L. 711-16 are transmitted to the supervisory minister of the chambers of commerce and industry, as soon as they are signed, by CCI France.

Approval is tacitly acquired on expiry of a period of one month from the date of receipt of these texts by the supervisory minister, in the absence of an express decision notified to CCI France within this period.

A refusal of approval shall be the subject of a reasoned decision.

The approval procedure suspends the notification, publicity and filing of the texts concerned, provided for in articles L. 2231-5 et seq. of the Labour Code.

Article R712-6-1

Les conventions et accords collectifs soumis à agrément conformément au premier alinéa du 6° de l’article L. 711-16 sont transmis au ministre de tutelle des chambres de commerce et d’industrie, dès leur signature, par CCI France.

L’agrément est acquis tacitement à l’expiration d’un délai d’un mois à compter de la date de réception de ces textes par le ministre de tutelle, à défaut de décision expresse notifiée à CCI France dans ce délai.

Le refus d’agrément fait l’objet d’une décision motivée.

La procédure d’agrément suspend la notification, la publicité et le dépôt des textes concernés, prévus aux articles L. 2231-5 et suivants du code du travail.
