Article R7123-28 of the French Labour Code

The guarantee commitment is the subject of a written contract specifying the conditions and the amount of the guarantee granted as well as the terms and conditions of the accounting control that the guarantor may exercise over the modelling agency.
This contract shall mention the waiver by the guarantor, in the event of default by the modelling agency, of the benefit of discussion provided for in articles 2305 and 2305-1 of the Civil Code.
The contract shall be kept available at the head office of the modelling agency for inspection by labour inspectors and inspectors of social security bodies and social institutions.

L’engagement de caution fait l’objet d’un contrat écrit précisant les conditions et le montant de la garantie accordée ainsi que les modalités du contrôle comptable que le garant peut exercer sur l’agence de mannequins.
Ce contrat mentionne la renonciation du garant, en cas de défaillance de l’agence de mannequins, au bénéfice de discussion prévu aux articles 2305 et 2305-1 du code civil.
Le contrat est tenu, au siège de l’agence de mannequins, à la disposition des agents de l’inspection du travail et des agents de contrôle des organismes de sécurité sociale et des institutions sociales.
