Article R713-1 of the French Commercial code

I.-The members of the local chambers of commerce and industry and the departmental chambers of commerce and industry of Ile-de-France are elected under the same conditions as the members of the territorial chambers of commerce and industry, subject to the specific provisions set out in this chapter.

In the event of special circumstances, the periods set in the order referred to in the previous paragraph may be modified by joint order of the Minister responsible and the Minister of the Interior.

IV -In the cases provided for in article R. 711-47-2, the conditions of organisation and the timetable for the electoral operations provided for in articles R. 713-1 to R. 713-6 are set by order of the Minister responsible.

V -When an election is to be held, the conditions of organisation and the timetable for the electoral operations provided for in articles R. 713-1 to R. 713-6 are set by order of the Minister responsible.
V.-When an election must be held before the next general renewal, following the definitive annulment of an election or in the cases provided for in Article L. 713-5, the organisational conditions and timetable for the electoral operations provided for in Articles R. 713-1 to R. 713-6 are set by the chamber’s supervisory authority.

Article R713-1

I.-Les membres des chambres de commerce et d’industrie locales et des chambres de commerce et d’industrie départementales d’Ile-de-France sont élus dans les mêmes conditions que les membres des chambres de commerce et d’industrie territoriales, sous réserve des dispositions spécifiques prévues au présent chapitre.

II.-L’autorité administrative mentionnée à l’article L. 713-17 est, pour l’élection des membres des chambres de commerce et d’industrie territoriales, le préfet du département où est situé le siège de la chambre et, pour l’élection des membres des autres chambres de commerce et d’industrie, le préfet de région.

III.-Au plus tard le 1er juin de l’année du renouvellement général, un arrêté du ministre de tutelle des chambres de commerce et d’industrie fixe les périodes de dépôt des candidatures et de scrutin. La date de clôture du scrutin ne peut être postérieure au troisième mercredi de novembre, à minuit.

En cas de circonstances particulières, les périodes fixées dans l’arrêté mentionné à l’alinéa précédent peuvent être modifiées par arrêté conjoint du ministre de tutelle et du ministre de l’intérieur.

IV.-Dans les cas prévus à l’article R. 711-47-2, les conditions d’organisation et le calendrier des opérations électorales prévues aux articles R. 713-1 à R. 713-6 sont fixées par arrêté du ministre de tutelle.

V.-Lorsqu’une élection doit avoir lieu avant le prochain renouvellement général, à la suite de l’annulation devenue définitive d’une élection ou dans les cas prévus l’article L. 713-5, les conditions d’organisation et le calendrier des opérations électorales prévues aux articles R. 713-1 à R. 713-6 sont fixées par l’autorité de tutelle de la chambre.
