Article R713-8 of the French Consumer Code

In the event of an appeal, a stay of execution may be requested from the first president of the court of appeal by summary proceedings. Until the day on which the order is handed down by the first president, the application suspends the effects of the judge’s decision, with the exception of that providing for the suspension of an eviction order. The stay of execution is granted only if the immediate execution of the decision is likely to have manifestly excessive consequences.

En cas d’appel, un sursis à exécution peut être demandé au premier président de la cour d’appel par assignation en référé. Jusqu’au jour du prononcé de l’ordonnance par le premier président, la demande suspend les effets de la décision du juge, à l’exception de celle prévoyant la suspension d’une mesure d’expulsion. Le sursis à exécution n’est accordé que si l’exécution immédiate de la décision risque d’avoir des conséquences manifestement excessives.
