Article R721-4 of the French Intellectual Property Code

I. – The Institut national de la propriété industrielle shall open the consultation on an application for approval of a specification provided for in 3° of Article L. 721-3 concomitantly with the publication of the notice of the opening of the public enquiry provided for in I of Article R. 721-3. The procedures for this consultation are specified by decision of the Director General of the Institute.

The consultation ends at the end of a period of two months from the date of referral by the natural or legal persons mentioned in 3° of Article L. 721-3.

The professional groups concerned referred to in Article L. 721-3 are the national organisations representing companies and craftsmen as well as the professional bodies representing industrial and craft product conformity assessment bodies referred to in Article R. 721-9.

II. – A consultation is organised under the conditions set out in I for any application to amend the approved specification. This consultation concerns only those elements of the specification that are the subject of the amendment request.

Article R721-4

I. – L’Institut national de la propriété industrielle ouvre la consultation sur une demande d’homologation d’un cahier des charges prévue au 3° de l’article L. 721-3 concomitamment à la publication de l’avis d’ouverture de l’enquête publique prévue au I de l’article R. 721-3. Les modalités de cette consultation sont précisées par décision du directeur général de l’institut.

La consultation prend fin à l’issue d’un délai de deux mois à compter de la date de saisine des personnes physiques ou morales mentionnées au 3° de l’article L. 721-3.

Les groupements professionnels intéressés mentionnés à l’article L. 721-3 sont les organisations nationales représentatives des entreprises et des artisans ainsi que les organismes professionnels représentant les organismes d’évaluation de la conformité des produits industriels et artisanaux mentionnés à l’article R. 721-9.

II. – Une consultation est organisée dans les conditions prévues au I pour toute demande de modification du cahier des charges homologué. Cette consultation ne porte que sur les éléments du cahier des charges faisant l’objet de la demande de modification.
