Article R721-7 of the French Intellectual Property Code

Prior to any decision to withdraw approval of the product specification, the Institute will serve formal notice on the defence and management organisation requesting it to comply with its obligations within a period allowing it to organise the inspection operations provided for in Article L. 721-9 or the implementation of corrective measures guaranteeing compliance with the specifications.

Decisions to withdraw approval are notified by the institute to the defence and management organisation.

Avant toute décision de retrait d’homologation du cahier des charges, l’institut procède à la notification d’une mise en demeure à l’organisme de défense et de gestion lui demandant de se conformer à ses obligations dans un délai lui permettant l’organisation des opérations de contrôle prévues à l’article L. 721-9 ou la mise en œuvre des mesures correctives garantissant le respect du cahier des charges.

Les décisions de retrait de l’homologation sont notifiées par l’institut à l’organisme de défense et de gestion.
