A debtor whose situation becomes irremediably compromised during the execution of the treatment measures provided for in Articles L. 732-1, L. 733-1, L. 733-4 and L. 733-7 may refer the matter to the commission under the provisions of article L. 724-2 in order to benefit from a personal recovery without judicial liquidation or a personal recovery procedure with judicial liquidation by simple letter signed by him and delivered or addressed to the secretariat of the commission.
This letter indicates the applicant’s surname, first names and address, mentions the applicant’s family situation and includes a detailed statement of the applicant’s income and the assets and liabilities of the applicant’s assets. It sets out the circumstances in which the debtor’s situation has become irremediably compromised.
