Article R733-4 of the French Consumer Code

When, pursuant to the provisions of article L. 732-4, the commission finds that the debtor’s situation, without being irretrievably compromised, does not allow for the repayment of all debts and that, as a result, its conciliation mission appears manifestly doomed to failure, it informs the debtor and the creditors by registered letter with acknowledgement of receipt.

Lorsque, en application des dispositions de l’article L. 732-4, la commission constate que la situation du débiteur, sans être irrémédiablement compromise, ne permet pas de prévoir le remboursement de la totalité des dettes et que, de ce fait, sa mission de conciliation paraît manifestement vouée à l’échec, elle en informe le débiteur et les créanciers par lettre recommandée avec demande d’avis de réception.
Cette lettre indique que le débiteur et les créanciers disposent d’un délai de trente jours pour présenter leurs observations.
