Article R7342-16 of the French Labour Code

When a case is referred to the court pursuant to the third paragraph of article L. 7342-10, the court clerk’s office convenes the parties to the proceedings before the industrial tribunal to a hearing, at least one month in advance and by registered letter with acknowledgement of receipt.

The notice specifies that if the parties fail to appear, a judgment may be handed down in their absence.

Lorsque le tribunal judiciaire est saisi en application du troisième alinéa de l’article L. 7342-10, le greffe convoque à l’audience, au moins un mois à l’avance et par lettre recommandée avec demande d’avis de réception, les parties à l’instance engagée devant le conseil de prud’hommes.


La convocation précise qu’à défaut de comparution les parties s’exposent à ce qu’un jugement soit rendu en leur absence.
