Article R742-21 of the French Consumer Code

The debtor’s property rendered unavailable by enforcement proceedings may be sold by mutual agreement by the liquidator, with the authorisation of the protection litigation judge, ruling by order, who justifies that this sale can be concluded under satisfactory conditions.
The order authorising the sale by mutual agreement of a property shall be published alongside the summons published at the land registry.

Les biens du débiteur rendus indisponibles par une procédure d’exécution peuvent être vendus de gré à gré par le liquidateur, sur autorisation du juge des contentieux de la protection, statuant par ordonnance, qui justifie que cette vente peut être conclue dans des conditions satisfaisantes.
L’ordonnance autorisant la vente de gré à gré d’un immeuble est publiée en marge du commandement publié au service chargé de la publicité foncière.
