Article R742-23 of the French Consumer Code

In the event of the sale by mutual agreement of a property subject to a mortgage, the judge responsible for protection disputes shall determine the minimum amount of the sale price.

Payment of the price in accordance with this amount, the costs of the sale and the transfer duties will release the property from all mortgages and liens taken out against the debtor.

At the request of the purchaser, the judge will determine the minimum amount of the sale price.
At the request of the purchaser, the judge notes the purge of mortgages and liens taken out on the property and orders the removal of the corresponding registrations at the service responsible for land registration. He shall rule by order.

En cas de vente de gré à gré d’un bien immobilier grevé d’une hypothèque, le juge des contentieux de la protection détermine le montant minimum du prix de vente.


Le paiement du prix conforme à ce montant, des frais de la vente et des droits de mutation purge l’immeuble de toute hypothèque et de tout privilège pris du chef du débiteur.


Sur requête de l’acquéreur, le juge constate la purge des hypothèques et privilèges pris sur l’immeuble et ordonne la radiation des inscriptions correspondantes au service chargé de la publicité foncière. Il statue par ordonnance.
