The clerk of a commercial court who wishes to benefit from the provisions of article R. 742-35 must send his application by registered letter with acknowledgement of receipt, or hand it in against a receipt, to the secretariat of the commission. The application must be accompanied by all relevant information and documents, in particular those relating to the applicant’s professional experience, work, diplomas and publications. The applicant must also specify the profession he or she intends to choose and the way in which it will be practised, and submit all supporting documents.
The Chairman of the Commission may appoint one or more rapporteurs from within the Commission. The committee may obtain any information that it deems useful for examining the application, in particular any information relating to the applicant clerk’s professional practice and the operation of his or her registry. It may interview the applicant.
The committee’s reasoned proposal is made within three months of receipt of the application; within fifteen days of its formulation, it is sent to the Minister of Justice. The committee’s proposal is deemed to comply with the application submitted by the registrar if it is not issued within the aforementioned period.
The Minister of Justice notifies the applicant of its decision by registered letter with acknowledgement of receipt.
