At the adjudication hearing, it shall proceed in accordance with the dispositions de la sous-section 3 de la section 4 du chapitre II du titre II du livre III du code des procédures civiles d’exécution, à l’exception de l’article R. 322-47.
The provisions of article R. 322-58 of the same code are applicable to the payment of taxed costs and transfer duties.
In addition to the information required for any judgment, the auction judgment refers to the judgment issued pursuant to article R. 742-28 or article R. 742-31, the judgements ruling on disputes and the schedule of conditions of sale. It indicates the name of the liquidator. It mentions the publicity formalities and their date, the description of the property awarded, the dates and place of the auction, the identity of the successful bidder, the auction price and the amount of the taxed costs. Where applicable, it includes the disputes that it settles.
The provisions of articles R. 322-61 to R. 322-63 of the Code of Civil Enforcement Procedures are applicable to the title of sale.
The sale produces the effects provided for in article R. 322-64 of the same code.
Overbidding is governed by articles R. 322-50 to R. 322-55 of the same code.
