Article R742-48 of the French Consumer Code

The protection litigation judge or, where applicable, the judge responsible for property seizures draws up the distribution statement and rules on the distribution costs. Where applicable, he will order the cancellation of the mortgage registrations on the property.

An appeal against the judgment establishing the statement of distribution has suspensive effect.

A copy of the judgment is sent to the court.
A copy of the judgment is sent to the liquidator by the court registry by simple letter.

Le juge des contentieux de la protection ou, le cas échéant, le juge chargé des saisies immobilières établit l’état de répartition et statue sur les frais de distribution. Le cas échéant, il ordonne la radiation des inscriptions des hypothèques sur l’immeuble.


L’appel contre le jugement établissant l’état de répartition a un effet suspensif.


Une copie du jugement est adressée au liquidateur par le greffe par lettre simple.
