Article R742-9 of the French Commercial code

The traineeship is completed with the clerk of a commercial court.

The Conseil national des greffiers des tribunaux de commerce draws up each year, in agreement with the clerks of the commercial courts, a list of proposed traineeships comprising at least as many proposals as places offered in the competition. These proposals specify the location of the traineeship as well as the dates or periods on which it begins and ends.

In the event of special circumstances, the Conseil national des greffiers des tribunaux de commerce may authorise the trainee to complete a traineeship not on this list, to change the place of the traineeship or to change the date or period on which it begins or ends, without being able to change the duration of the traineeship.

Where the duration of the traineeship is one year, the Conseil national des greffiers des tribunaux de commerce may authorise the trainee to complete his or her traineeship for a period of at least nine months in accordance with the procedures laid down in the first paragraph of this article and for a period not exceeding three months either with a lawyer, a chartered accountant, a court-appointed administrator, a liquidator, a notary, a bailiff or an auctioneer, or with a public administration or in the legal or tax department of a company. Refusal to authorise these methods of completing the traineeship may be referred to the Paris Court of Appeal within one month of notification to the interested party by registered letter with acknowledgement of receipt.

Le stage est accompli auprès du greffier d’un tribunal de commerce.

Le Conseil national des greffiers des tribunaux de commerce établit chaque année, en accord avec les greffiers des tribunaux de commerce, la liste de propositions de stages comportant au moins autant de propositions que de places offertes au concours. Ces propositions précisent le lieu du stage ainsi que les dates ou périodes auxquelles il débute et prend fin.

Les lauréats du concours choisissent leur stage, parmi cette liste, dans l’ordre de leur classement aux épreuves du concours.

En cas de circonstances particulières, le Conseil national des greffiers des tribunaux de commerce peut autoriser le stagiaire à effectuer un stage ne figurant pas sur cette liste, à changer de lieu de stage ou à modifier la date ou période à laquelle il débute ou prend fin, sans pouvoir modifier la durée de ce stage.

Lorsque la durée du stage est d’un an, le Conseil national des greffiers des tribunaux de commerce peut autoriser le stagiaire à accomplir son stage pour une période d’au moins neuf mois selon les modalités prévues au premier alinéa du présent article et pour une période n’excédant pas trois mois soit auprès d’un avocat, d’un expert-comptable, d’un administrateur judiciaire, d’un mandataire liquidateur, d’un notaire, d’un huissier de justice ou d’un commissaire-priseur judiciaire, soit auprès d’une administration publique ou dans le service juridique ou fiscal d’une entreprise. Le refus d’autoriser ces modalités d’accomplissement du stage peut être déféré à la cour d’appel de Paris dans le délai d’un mois à compter de sa notification à l’intéressé par lettre recommandée avec demande d’avis de réception.
